USER AGREEMENT

1. GENERAL

This Website is provided solely to assist customers in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations or otherwise transacting business with travel suppliers, and for no other purposes.

The terms "we", "us", "our" and "Amargo" refer to Avians LLC. The term "you" refers to the customer visiting the websites www.amargo.ru, www.amargo.cn, www.amargo.com  (the Website) and/or booking a reservation through us on this Website, or through our customer service agents.

This Website is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Agreement"). By accessing or using this Website in any manner, you agree to be bound by the Agreement.

The Agreement is considered to be concluded after activation of the «I Accept terms of the offer, IATA, TCH agreements, rates» section. After that the Agreement is considered to be basic document in legal biding between Avians LLC and it’s users.

Avians, LLC. reserves the right at any time, at our sole discretion, to change or otherwise modify the Agreement without prior notice, and your continued access or use of this Website signifies your acceptance of the updated or modified Agreement.
By accepting the terms of the Agreement You:

• Confirm you are sufficient legal age and can enter into binding contracts, you acknowledge legal obligation which arises or in any way connected with the Agreement or use of the Website
• Will use this Website in accordance with this Agreement; you will only use this Website to make legitimate reservations for you or for another person for whom you are legally authorized to act;
• Confirm reliability of your personal information supplied by you on this Website as well as personal information of  another person for whom you are legally authorized to act; acknowledge the responsibility for it’s accuracy,  reliability and completeness

• Acknowledge that all the agreements on travel, hotel, insurance, etc. services displayed on the Website, are made directly between you and suppliers of the service.  
• you will inform such other persons about the terms and conditions that apply to the reservations you have made on their behalf, including all rules and restrictions applicable thereto; In this case  you agree that each of the services you have purchased is an independent. Purchase of the several services simultaneously does not create a complex of purchased services. Relations arising in connection with the provision of each service are regulated separately and are not affiliated with the relations arising in connection with the provision of other services.
• Agree that your personal data will be processed in order to execute this agreement and agreements with organizations, suppliers, service providers.
• guarantee that all information supplied by you on this Website is true, accurate, current and complete, 

• you will safeguard your account information and will supervise and be completely responsible for any use of your account by you and anyone other than you. We retain the right at our sole discretion to deny access to anyone to this Website and the services we offer for violation of this Agreement.

 Additionally, you agree not to:

• make any speculative, false, or fraudulent reservation or any reservation in anticipation of demand;
• access, monitor or copy any content or information of this Website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission
• take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure
• use any portion of this Website  for any purpose without our express written permission
• "frame", "mirror" or otherwise incorporate any part of this Website into any other website without our prior written authorization.
  

2. SUPPLIER RULES AND RESTRICTIONS

Information on schedules, availability of the services provided by Avians LLC, including tariffs, rules and conditions imposed by the supplier, limitations of use and other terms of service provision, is displayed on the Website in accordance with supplier’s and their affiliates automated reservation systems.

Additional terms and conditions may apply to your reservation and purchase of travel-related goods and services that you select.
Accepting the terms of the Agreement you;

• You agree to abide by the terms and conditions of purchase imposed by any supplier with whom you elect to deal, including, but not limited to, payment of all amounts when due and compliance with the supplier's rules and restrictions regarding availability and use of fares, products, or services.
• You acknowledge that some third-party providers offering certain services and/or activities may require you to provide additional information sign their liability waiver prior to participating in the service and/or activity they offer
• You understand that any violation of any such supplier's rules and restrictions may result in cancellation of your reservation(s), in your being denied access to the applicable travel product or services, in your forfeiting any monies paid for such reservation(s), and/or in our debiting your account for any costs we incur as a result of such violation.
• Acknowledge that Аvians llС is not liable for suppliers’ and their affiliates’ failure to comply the terms and rules of air tariffs as given terms and conditions are in suppliers’ sole discretion.
  

3. PAYMENT

Avians LLC reserves the right to charge users additional fees for access to booking and issuing services displayed on the Website.  The fee is included in total price and is not refundable in case of return shipping and other documents confirming the fact of processed services.

The presence and amount of these fees varies depending on the conditions offered by Avians LLC service providers. Service fees for returns or exchanges levied LLC Avians on demand of service providers, depend on the rules and restrictions imposed by service providers, and need to be specified the on the day of return or exchange.

If the services are paid through the bank card via internet-acquiring Avians LLC guaranties not to store information about the number, duration, or other data of users cards. The whole process of authorization and transfer of funds from the user's account is in a secure connection. Additional fees may be charged in the process payment via a bank card and / or other instruments of payment that cover the Amargo costs for the payment systems services. In accordance with the terms of agency and other agreements LLC Avians with service providers, prices on the site are formed in one of three currencies-Russian Ruble (RUB), the U.S. dollar ($), Euro (?). Exchange rates posted in the automated reservation systems and services on the Site may differ from the rates on the foreign exchange market. While booking user sees the value, depending on his or her chosen currency. All calculations are made in rubles. If you use a card with another currency, your bank will recalculate the amount of payment on their internal exchange rate. In this case, the amount actually paid may differ from the amount shown on the Website as background information, as the internal rate of the issuing bank may be different from that used by service providers.

Avians LLC has the right to grant privileges to users of the Site in the form of special fares or discounts when purchasing a particular service. Thus, under the concept of «discount», we understand the cost reduction within Avians LLC loyalty program, which rules and conditions are presented on the Website.

To confirm the expenses incurred by the user when purchasing services on the Site, Avians LLC provides an automatic acquisition of confirming payment documents on user's mailbox. In accordance with the RF legislation under the documented confirmed expenses is meant the costs certified by documents processed in accordance with the laws of RА or the documents executed in accordance with the customs of the business turnover, applied in a foreign country, on the territory of which the expenses were incurred, and (or) documents, indirectly supporting the incurred expenses. In accordance with the Tax Code and a letter from Ministry of Finance from 17.07.2007, the № 03-03-06/4/99, documents confirming the payment, as an example, for air travel may be the passenger itinerary receipt issued under the approved form and original boarding passes. Provision of other documents, including the sales receipt proving payment of services purchased on the Site is produced at user's request.

4. RESPONSIBILITY

The information published on this website may contain inaccuracies or errors, including pricing errors. In particular, Avians LLC does not guarantee the accuracy, and disclaim all responsibility for any errors or other inaccuracies of the information and description provided by the suppliers of the hotel, air, cruise, car and other travel products displayed on www.amargo.ru. This includes including without limitations the pricing, lists of hotel amenities, the relevance of photographs and descriptions of services in general, etc.   In addition, Avians LLC expressly reserves the right to correct any errors on our website on receiving information proving inaccuracy. In the case of incorrect pricing Avians LLC will give you the opportunity to resolve disputes with service providers directly, and commit ourselves to assist in resolving such disputes without without suppliers penalty.

The Website is a dynamic system, which components may be changed, updated, added to, limited or terminated, at any time, temporarily or permanently, without notice, for any reason or no reason by Amargo in its sole discretion. In a case of current or permanent disability of the Website and it’s components during unspecified period of time as well as inability to access  the Website, Amargo disclaims all liability for any loss or damage which arises out of or in any way connected with any of the occurrences described above.

• acknowledge and agree that Submissions are non-confidential and non-proprietary. We take no responsibility and assume no liability for any Submissions posted or submitted by you. We have no obligation to post your comments; we reserve the right in our absolute discretion to determine which comments are published on the Amargo.ru website.
